"Brookfield Infrastructure has lost a bid to further thwart rival APA Group in the battle for AusNet Services, after the Takeovers Panel rejected its claims of APA making misleading statements.

The Canadian giant, midway through due diligence on AusNet, said on October 4 that APA had made “misleading and incorrect” statements, undermining the principle of an informed market.

It accused APA of making announcements on September 24 and 29 that “contain misleading and incorrect information, undermining the efficient, competitive and informed market principle”.

However, the Takeovers Panel said it had declined to conduct proceedings.

“The panel concluded there was no reasonable prospect that it would make a declaration of unacceptable circumstances in relation to the matters raised in Brookfield’s application (that announcements made by APA contained misleading and incorrect information),” the Takeovers Panel said on Friday..."
