Would agree to bind performance rights against timings, though I think they could be more extended out than those you provided, which have no chance of coming to pass. Yes I know they are from management's own timelines but let's be honest about those. Instead, build in realistic milestone timelines based off the held-back OFS, and put those in front of the AGM and I'd vote for them.
the current performance milestones I actually find quite offensive, and across my portfolio few (read: no) companies so consistently set aggressively low-bar hurdles whilst also so consistently under delivering on their stated expectations. Especially given the outsized board-to-staff ratio, and the outsize pay packets for a new developer turning over no profit.
I don't think we have much likelihood of avoiding this latest batch of performance rights, given NFs likely support from the handouts they've dished out, but if we all vote NO pre AGM it will send a strong message of retail shareholder dissatisfaction. Which I think is important to transmit.
