Without having had an opportunity to review the documents, I suspect that the language that you referenced in your earlier posts was an explanation of the extent of the BLM’s discretion with respect to the Proposed Plan of Operations. The three options that you set out don’t really conform to any particular decision-making process under the National Environmental Policy Act.

Of course, there is a relationship: if the BLM does not issue a Finding of No Significant Impact upon its analysis in the Environmental Assessment and elects to proceed to a full blown Environmental Impact Statement, then it will simply disapprove the Proposed Plan of Operations pending completion of the EIS and an associated Record of Decision. In that RoD, the BLM will again have the options that you set out in your previous post with respect to the Proposed Plan of Operations.
