Mate I think you have been misinformaed.

MMX's defence is not Grimaldi & Barnes. Someone tried to report from the courts that there opinion was that MMX's defence was Grimaldi & Barnes because MMX didn't have their own defence on a particular situation (this was before the first delay). I think you will find that person was not understanding the whole case but only what was played out in front of them.

CHM must first prove that Grimaldi & Barnes did wrong before they even get a look at MMX.

I think that is why MMX would have supported Grimaldi & Barnes application to have the original hearing deferred. The better Barnes & Grimaldi go the better MMX goes & the less it has to defend.
