It might be unreasonable and unfair to long-term investors, but it certainly isn't "technically in breach of the offer".
It was BKW's decision to allow a window of opportunity for people to get on board in time for the record date, so perhaps you should direct your vitriol towards the company's directors, rather than those wishing to contribute capital to the company. I'd support you in doing so!
