    Your right although l think MMX will be OK ,anything can go wrong in court, theres always a risk , l definently would'nt say anything critcal of anyone who sells MMX now and does'nt want to take the risk it could turn out to be the right decsion.
    regarding your options question, sorry l don't know the answer, maybe someone else knows
