Harte's response to Appian's motion and new offer.
Looks like Harte's position is that Appian have had plenty of time to step up and make their best offer. Despite negotiations with Harte going back to May, Appian's first offer didn't come until November. Harte reached out to Appian in July and August but they never confirmed if they would make an offer.
Appian's revised offer also includes that any 'superior offer' be all cash. "Harte Gold views this suggested definition of a 'superior offer' in the SISP Procedures as being problematic". Harte is against the second Appian offer because they feel that this requirement to be all cash will put off prospective bidders.
