Police are able to enforce Public Health Orders under the Public Health Act 2005.
Police are able to enforce lawful orders under the Police powers and responsibilities Act.
The cafe owner has allegedly contravened a public health order, by failing to comply with the Public Health order. That is not a law.
It has nothing to do with ministerial powers. The public health act provides the powers. The public health act enables governments to make public health orders, the police are then able to enforce them under the public health act. At no time are they crimes, crimes may occur in resisting arrest or failing to comply with a lawful order under police powers and responsibilities act.
