    Futher points to consider here:

    Up until this point AGS has been very careful to stick to the " Letter of the Law " regarding the terms of the joint venture, such as

    - Making payments towards cost contributions as required under the joint venture agreement, even though things werent going well between them

    - Attempting to obtain appropriate information fron Quaser to inform the Market under their Regulartory obligations. Which they are still trying to do.

    - Following the "Letter of the Law" by not accepting the Native Title Agreement negotiated/signed incorrectly by Quaser/Heathgate instead of AGS`s authorised signatory, as specified by the joint venture agreement.

    Therefore it appears that AGS has in no way breached the conditions of the Joint Venture on the information we have so far

    Does it appear Heathgate/Quaser have breached the Joint Venture Terms???

    Well it would appear so in at least the important Native Title area which has not been ratified due to Quaser`s actions. And probally in the area of inadequate/"incorrect" information on grades and costs being given to AGS.

    If this gets to Court Quaser/Heathgate will will be required by the Court, for its consideration, to supply ALL the facts and figures that AGS have been unable to obtain to date.

    Will Quaser want to do that, NO WAY !!!!!!

    Will they want to avoid this at all costs?? YES !!!

    But another point to consider here are the court delays that always occur in such things. Quaser will stretch this out for as long as they can with every excuse possible.

    I held BTA shares a few years back when Glaxo tried to screw them . They went to court, it dragged on, BTA`s share price dropped lick a brick BUT BTA got a much better deal and have now done well.

    As I said before , this will come down to a cost analysis by the Blues Boys numbers crunchers. They know they will, eventually, get screwed by the Courts if it goes to the end.

    So the question is how far do they think they can take the delaying tactics to wear out AGS in this.

    I feel the lure of the lost dollars, and fear of any publicity, will force the Boys to the table once the realise AGS are prepared to wait for the fair deal here.

    The drop in the share price in the short term will not sway them obviously. Materally the share price drop does not affect AGS`s ability to pursue this due to their cash position.

    So we wait now, its finally all out there.

    Your choice is to sell now and look elsewhere or be patient for longer than you hoped you would have to.
