I think we will find that the decision will be made long before the bureaucrats make their minds up. Rail access will be a key deciding factor in allowing the BHP/RIO deal to go through. BHP will not want to wait around for a possibly unfavorable decision and make a move first IMO. The deals already done with IOH and UMC point the way .
I am expecting some sort agreement that will see the NWIOA allowed to go ahead and produce to their ore to port thus reducing overall concerns about a monopoly in the area.
