It would be justice if you were right and I would like to be wrong about this.

However, my guess is that the company would be able to muddy the waters enough to show that they had some basis for their claims (I know the legal test is stronger than this - based on what a reasonable person would do) but this would probably be enough to deter litigation.

Another factor is that this kind of litigation is incredibly expensive and runs into many millions of dollars. As a result it is usually funded by litigation funders who want a high level of confidence that they will get paid for their efforts. Here, it is questionable whether any settlement would cover the cost of litigation. There is a reason that no one ever sues a Fish & Chip shop - even if you win you lose.

From a shareholder point of view, it is never worth holding hopes of a win in the courts. Although these actions usually win (the insurers cave in to avoid mounting costs) they are rarely rewarding for shareholders as they finish up recouping only a small fraction of their losses.

I am currently in a class action like this over QIN which went into administration more than four years ago and there is still no sign of a resolution. Maybe I will eventually receive enough compensation to buy a case of wine, but even if the wine is Grange it will go nowhere near covering my losses.
