There are 3 patent families:
1. PPS and BML: This patent has been issued. Provides protection until 2032. In January 2018, Paradigm Biopharmaceuticals Ltd announced that it had been granted a European patent for the treatment of Bone Marrow Edema Lesions with Pentosan Polysulfate Sodium (PPS), and throughout 2018 has validated the patent in European member states. The European registration enhances Paradigm’s already strong patent position, adding to previously granted registrations in Australia, the United States, Japan, China, Canada, Taiwan, Singapore and other countries across the Asia-Pacific.

In order as new things have been discovered we have added additional patents.
2. PPS, BML and improved knee function: This is the one just rejected
3. PPS and NGF (i.e. pain): This still going through evaluation but could be rejected

The Bene exclusive supply agreement for 25 years just adds another powerful layer commercial protection. Bene is the only FDA approved supplier of PPS and no generic has been made as there are complex steps to manufacture it and Bene own the IP for specific manufacturing custom built procedures.

Elmiron (oral PPS) sold by J&J came off patent in January 2010. But due to their exclusive supply agreement with Bene no generic competitor has been able to enter the market.

So for going commercial negotiations for OA having as many patents and exclusivity supply with Bene is the best outcome. I think it is that basic
