    They don’t get to agree. If one decides not to participate in the arbitral proceedings and make their defence, the arbitrator will decide and make his award solely on the basis of the evidence before him. Remember that DRC is a signatory to the New York Convention 1958 on the enforcement of foreign arbitral awards.
