Yes, the current dispute involves whether the new parties can be added when they chose not to participate when the opportunity (arguably) was available. This has nothing to do with the Hualapai, who can't commence the suit against BLM until (unless) the government gives AZL permission to drill.
I have never said that the Hualapai will win. The point is that they can delay the project for years. In the meantime, state laws might be enacted to prevent groundwater from being used for mining in that area. Or the water might not be available despite lack of management.
I expect the Hualapai will win, though, if AZL persists in digging holes and pits within a few hundred meters of the springs owned by the Hualapai. And that happens to be where the best samples were taken, when 4% of the claims were explored.
