But since I have now witnessed and experienced the woke and cancel culture movement of our weird society. So, to avoid being removed for ‘flaming and baiting’ let me not name any names to still express my right to what remains of freedom of speech.
So, to those of you who are still confused by the plethora of the so called ‘intellect’ of acronyms, jargon and attempted legalese let me put it simply to what the conclusion of the 5 year Billabong (SGI) case is all about. Its quite simple you don’t need to read the obiter dictum or findings or rulings which can be quite confusing. All you must know and read is the final orders issued by Justice Martin that SGI and Vango have signed and agreed to and that is:
SGI have ‘won’ the right to possibly enter into a mutually agreeable JV and/or mining agreement for K2 that needs to be beneficial to both parties. If the agreement is not mutually acceptable and/or beneficial to both parties, then the arrangement is dead.
There are no other orders in place with SGI, no OTA’s, no agreements other than the outline of the intent of the BTS (Binding Term Sheet) that Justice Martin ordered above.
SGI have also been awarded 80% of their costs however SGI has decided to appeal the decision which means all of Justice Martin’s rulings (if the Appeal is granted) will be open up for review including costs (in 12 months’ time).
In my observation Justice Martin has very rarely been overturned. He has cited over 14 precedent cases and has detailed at length strong legal rationale as to why Billabong claim under the 2016 agreement is to be dismissed.
