With what's been disclosed so far, I'd say there's practically no chance of Nuix winning against Sheehy - doesn't look defendable. Castagna's "undocumented agreement" will be given the weight it deserves - zero. Their only chance would be a really smart barrister who could pull a rabbit out of the hat during the trial - but more likely some settlement will be worked out before trial starts. Macquarie would no doubt prefer the trial doesn't happen.
Only real issue will be amount Sheehy is awarded - problematic because what he's entitled to is likely more than what Nuix can pay.
