Correct, but that will not be a consideration that the Plaintiffs will take into account given the amount of assest of CER and CNP.

Partially correct, there are such things as contingency fee agreements, and while we do not know if that is the case here the Lawyers may not get paid if they dont win. also the Law makes Lawyers liable for actions that have no substance and may order the lawyer to pay all the costs
