Not sure what the regulators motives are, but guess they have to be seen to be doing something - fixing the system isn't going to be it. So start an investigation that will drag on for ages and go nowhere. Clear from the article that you'll only be in trouble if you were falsly claiming to be struggling. Funny how the article neglects to mention that the $22m is going straight into paying off debt from running unprofitable business.
