Declarations of war are a little last century -
it is more concerned with the implications of what "war" would mean inside Russia, including what would be a contentious forced mobilisation of the population (currently Russians can legally refuse to join the "war" effort, if they know their rights and can withstand intimidation tactics - war offices which have been firebombed by citizens already, use different pressuring tactics and say misleading things to those who don't understand what is happening - soldiering contracts which look almost identical to a conscription notice can easily fool poor lowly educated people in the regions, they have also implemented community walls of shame for people who have refused to extend their soldiering contracts, so that family will turn on them, etc), it would also mean a transition to a wartime economy / rationing / new laws, and it affects international relations due to alliance structures and policies of multilateral bodies. All these things would mean Putin admitting he stuffed up with "special military operation". It is a state on state war in all ways but official title. Interesting thing about crimes, USA, Russia and Ukraine aren't members of the ICC...
