Just pay the monies into Court and get ISX v ASX listed for a final timetable and a hearing. The shareholders who have been so loyal to this company for so long deserve better than a weak capitulation at the 11th hour. Those advocating what is effectively a white-flag surrender to ASX whilst dressing it up as a prudent litigation decision have dreadfully let down those that have supported them. That would be an appalling outcome no matter what rhetoric is used to attempt to convince otherwise.
ISX/SP1 knew how this would play out. If this fizzles like a damp squib after the bravado we heard uttered to Alan Kohler and the mention of 'cannabalising' the oppressors, what sort of message does that send to those who would seek to entrust those individuals again in any future endeavours.
