IMO RNU's best strategy was to seek a licencing agreement with EGR and as a bargaining chip in these discussions, agree not to file supporting evidence in the patent opposition. Its a much lower risk strategy than the binary win/lose battle they are playing through the patent office. It also opens up the possibility of selling graphite to EGR who at the moment are geographically by far the closest potential customer for RNU. Going this route avoids needing to develop a new process which would potentially require restarting any testing qualification (massive delays for RNU!!). It also avoids the problem of trying to find a process that is legally acceptable.

One permutation is that they are in discussion with EGR on a licencing deal and have sought an exceptional circumstances extension because they haven't concluded the deal but the 16th filing date has come around.

this whole exercise by RNU has been an attempt to delay EGR patent approval. They have run out of normal time so they now go for an extension. What a Effing Joke. If EGR has any say in this extension then there is no way they should allow an extension. If RNU and Dorf cannot work out why EGR’s process should not be granted a patent in the 6 months they have had then they are either incompetent or just trying to delay this for commercial reasons?
