This is 1 of the biggest furphy's that is constantly repeated on HotCopper. As the ASX states themselves, it is up to the entity and only the entity, that can and must form a view as to whether the information it knows is market sensitive.

Every ASX listed company has to select the box for each announcement if it is market sensitive or not, the compliance office at the ASX can review the selection and make comment (as they can with every detail within the announcement), but it solely up to the company to select that initial box
