It's a little more complex.. the ATO issued proceedings against the wife for $5.7 Million (Vlado; $9M) which the wife appealed and won against the ato in the Full Federal Court in 2016. The ATO amended its claim from $5.7M to less than 5% of that! ($less than $500k). The Wife also now won the High Court case against the ATO. Vlado, like many business peoplel I know, simply did not have the energy and resources to keep fighing the ATO (which has broken many businesses with aggressive and manifestly unjust demands) for the outrageous figure they plucked out of the air, including over the top penalties and interest. The easier option (given they were already facing a long and exhausting High Court case, was to simply declare bankruptcy.
The fact that the ATO lost two Court cass against them is good evidence that these demands are not straightforeward and most people simply do not have the funds to fight it.
I would not rush to a moral judgement or financial judgement of Vlado (in relation to ahi) on this basis.
