The judge doesn't "call not guilty." The judge will accept a hung jury once she accepts that all avenues of reaching a verdict have been exhausted, which will likely happen today. Then there may well be a retrial. A hung jury is not an acquittal. A verdict to either convict or acquit must be unanimous.
