Hi elzephyrus , your answer to that whole question is fully cleared up by TS in the last BRR interview in Sept 2009 .

He basically states that MCC have missed two environmental deadlines through no fault of Cape Lamberts ,and under the terms of the agreement they have to pay .
If they dont they cant do anything on the land .

The interview is well worth a listen ,and the relevent part is virtually at the beginning of the webcast .
