I understood that EBTEC were under contract for the plant design. I would presume the performance guarantee means that EBTEC are obligated to provide design and commissioning services (including plant modifications) until the plant achieves the production rate of 90,000TPA, ie as part of their original fee. You would expect their ongoing attendance on site is being paid by EBTEC.

But I agree with you, the emphasis on this performance guarantee seems to be overstated. But without knowing the detail how would you know.
