Those who don't vote are abstaining, so there is no proxy for them.
The Supreme Court hearing was listed for this morning at 9:15 so I'm expecting an announcement today to provide an update. I think the most likely outcome is that the consortium will have pulled the pin and won't proceed with the meeting / vote. Otherwise I think the next most likely outcome is that the court will knock it on the head.
