REVISED OFFER - Seriously WHAT SHOULD WE DO NOW.. HELP.., page-228

Lets say MIN get to 40% and the deal falls through as we believe/hope it will, somewhere well short of 90% anyway!
If at 20% you must launch a takeover bid how can MIN then sit at that 40% of NWE from that point on, do they need to sell back to 19.9% or are their special rules that allow them to hold 40% because of the takeover offer and we just press on with that scenario ?

I've tried to find answers but dead ends so far on the question..
