There's essentially a 2 stage process. Applicants apply for whatever it is they seek. NOPTA as the autonomous authority of jurisdiction follow their rigorous procedures and due dilligence according to very specific guidelines.
They (nopta) then arrivecat their decision/recommendation.
After this that recommendation passes to the J.A. for the actual outcome yay/nay.

The only thing that has happened is the final decision as previously prescribed by Scotty of FailuresRus, has been set aside. The final decision is put back upon the J.A.
It will take in the same, the very same NOPTA recommendation. ( nopta isnt about to waste time re-raking the same field. It's not required to )

The J.A will take on board the NOPTA recommendation as well as the view of the relevant bodies for NSW.

In practice the view of NSW with respect to a Federal Concern is all but irrelevant. NSW have much more say on land.... sea... beyond the State limit....not so much.

As was the case previously, NOPTA said YES
Barilalo ( for NSW ) said NO.
Pitt...was to have given it the go-ahead as the relevant Federal Minister essentially has power of Veto.
This was why Scomo was desperate to insert himself into the seat of decision.

They, BPH, are only in the 'same ' position in that they await the .J.A.
