From Australian case law, a mining applicant does not have a legitimate expectation of gaining ministerial approval, but rather a legitimate expectation of receiving procedural fairness.

From my reading, the Minister in this case acted in accordance with the discretion's purpose. He considered all the information at his disposal, otherwise he would be acting improperly as a regulator of the industry in South Australia.

Well in that case, if he can act in accordance within his discretion's purpose what confidence does that give to other miners and investors who are developing their projects in this state when a minister can simply ignore his own ministers determination. The Congo is looking less riskier than south australia at the moment
