    It depends on the adverse findings. After an appeal, it is often found that a judge has ruled incorrectly. If the judge finds "on balance" that he thinks that something is wrong, unless some clear evidence of breaking the law is found, I would await the appeal decision - if ISX decided it was worth an appeal.
