They still haven't said the ML depends on the ICC case.
They have simply presented what they believe is the worst case scenario.
What a lot of SHs forget is that the situation is constantly changing. What was said a few months ago may not be the case today. It certainly does make it more difficult when announcements don't convey all the information, however that's the nature of the beast.
