    This is all extremely pertinent information. It clearly indicates that the patentors have done a lot of work on developing these technological responses to problems with earlier designs. It is clear that these features could only be arrived at by someone working directly on a device that is, or is very like, the AudioPixels MEMS device. And someone with a FAB at their disposal that is able to do iterative developments at this level. That puts EM squarely in the centre of that work. My concern is that EM has patented features that appear to be vital to the proper and reliable functioning and durability of the MEMS. AP's Danny Lewin's presentation from a couple of years ago alluded to the invaluable technical contributions and great attitude of EM in making the MEMS work properly. This work most likely indicates that to be clearly the case.

    So where are the names of the developers of the original AP MEMS in this patent? AP seems to have developed, and patented, the basic MEMS concepts and control systems that represent its novelty and that drive it. EM have used their technological expertise in fabrication to make a product that works as the original concepts required. Both parties are now undoubtedly indebted to - and dependent on - the other.

    Exactly how the commercialisation of this plays out is going to be very interesting.
