There's nothing stopping you from suing the firm behind the algo/HFT if you think you can prove that the strategy was manipulative. But you would need to have suffered substantial loss otherwise why would you even want to sue them. You can almost forget about the exchange/regulator doing anything unless the manipulation is blatant and results in all of us shareholders suffering substantial losses. The better way of approaching it would be to identify the brokers behind the majority of the algo/HFT trades and let the regulators take any necessary action against them. Who's got broker data where we can work out the number of trades(buy+sell) to total volume ratio?
