    Nameuser - a few points as I see it (but all open for discussion)

    You lost me there - I sort of look at it like buying aused car - you go in low with first offer but I may be wrong)




    Transaction is far more complex then the parallel you're drawing

    Hang on - who are the creditors they are really just Toll and YAG when it comes to dollar valued votes

    If it is liquidated for less than owed they will surely loose money wont they - dont they have around US$25 MIL EACH EXTENDED IN LOANS - ALL UNSECURED




    According to my calcs Toll may be better off if purely calculated on the 10.5 mil swap for equity as against the 12.1 mil return using FH's $0.32 in the dollar forecast minimum payout to creditors......uhhhhhh...hmmmmm...

    Pretty sure HNC have first dibs at Joint Venture Assets so any liquidation should see first right of refusal going to HNC - if I recall correctly HNC have more than first refusal I think they can match any other offer under some sort of formula.




    Maybe so but I can't see a bidding war leading to a positive shareholder return post liquidation...




    HNC have for mine also declared their hand towards Toll and YAG - if I recall correctly they are refusing to agree to readmitting CMR as non defaulting JV partners after this murky deal/DOCA is sealed




    So "hypothetically" would you think they would treat a shareholder recap any differently....uh......no...

    The above is motivated due to my personal greed to preserve capital and minimise loss at all cost...
