The DR may come up with some excuses i.e poor mouth and didn't have the funds, but other factors come in such as emails and communications basically any discussion to mitigate consequences and keep PGI informed. All that will count for or against them.

DR is also a big recipient of bank loans as a third world country. They may claim that they could not exceed some borrowing limit.. pure B.S because the Bank would lend against an established operating business. So I can't see any traction for DR there. My optics on this is that it was basically crude stand over tactics by DR over a small foreign company believing there were no consequences. PGI would pull stumps and leave quietly.
