If it is active, they are in a catch 22. Legally they have to disclose all intercepts and augur results, but the illegal miners would then likely just strip those locations down to 35m... X marks the spot.
They need to quantify the problem and keep the market informed of new activity and the scale of it. If it is just a few blokes no biggie, but if it is a major operation involving hundreds... problem.
