They are two different things but as I have asked before who will enforce any penalty judgement from the ICC ? The international community haven't been able to do anything about the human rights abuse in the DRC so what hope has a commercial court got of ensuing their rulings will be carried out ?
Even if AVZ win in court and the $50k Euro per day penalty is awarded there is still no way they can force the government to award a mining licence to AVZ .
