the testimony was that there was no way of knowing what the custodian transfers were - he couldn’t say whether they were commercial transactions or the shuffling a holding (changing broker platform etc)
of the limited non-custodian transfers, some super transfers, deceased estate and spousal transfers were evident, with one confirmed commercial transaction
it’s a fair leap of faith to infer that, based on the number of commercial transactions within the small amount visible, that there was unlikely to be many within the larger population of custodian transfers.. but the expert thought it was a reasonable conclusion to make.. whether the judge accepts that or not remains to be seen
boring day.. the witness seemed nervous, hopefully that was the reason for struggling to understand the questions on a couple of occasions
