    Many AVZ shareholders are worried and frightened with this ICSID arbitration announcement. I was too in the beginning, but when I thought through it, and with some logical thinking, I felt that things are not that bad. Some of the astute contributors in the other site helped me in my thinking, so I am borrowing some information from that site. I am jotting down my thinking, hopefully this post might give the shareholders some comfort.

    So, this is not for compensation. Just to get the DRC to provide us the PE for the whole of 13359. By going to ICSID, the company may be thinking long term irrespective of who wins the election in Dec.
    The registration was confirmed today, so obviously the case registration was applied a while ago. Normal time frame to get registration:

    So, the application process might have started in March or April, after the MoM cancelled the decree for the southern section in Jan 2023. This arbitration application might have forced the DRC govt to take some actions. That 'action' resulted in Jin Cheng and Comminere jointly gone to ICC for compensation from AVZ. Why?
    The recent RCCM data indicates that Jin Cheng is out of Dathcom. The inference is that Jin Cheng is out due to certain Govt action, so they are claiming damages from AVZ.
    So, there is some progress and I believe it is positive for AVZ. Meanwhile, the news on ICSID arbitration registration came by. Company announced it, but my thinking is that this 'out of place news' shouldn't cloud our thinking and no need to get worried unnecessarily.
    To get the full perspective, in a very brief nut shell:
    • MoM issued a decree in April 2022 for PE for the southern section
    • AVZ questioned that decree and went into voluntary suspension
    • During the Perth road show, Nigel specifically said that the company is willing to give up the northern section if the President requested it.
    • There is no indication that the President requested the northern section.
    • MoM cancelled April 2022 decree in Jan 2023 and the whole of 13359 became one
    • Jin Cheng is out of Dathcom as of May 2023.
    You can clearly see there is progress, but definitely it is taking time.

    The non holder brigade here is trying to make us believe that the poor man hanging there is AVZ, but when I look at the whole picture, it is actually Jin Cheng. They are out of Dathcom and suing us for damages for a certain govt decision. Isn't it hilarious?
    Their other contention is that the management is incompetent. Our management definitely has limitations, but which company has perfect management? We are still there, the process is taking a bit too long, so go ahead and blame the management for everything.
    They say DRC is corrupt. There are plenty of corrupt actors there for sure. If it is corrupt from top to bottom, the only thing the president should do is to request the northern section and they can get plenty of money from other suitors. This didn't happen, so take your inference from here.
    Just look at our own RBA with legions of competent financial analysts working there. The governor publically announced in Oct 2021 that there will be no rate rise until 2024. Just 6 months later he has to eat his words. What about those 300,000 new home owners who trusted his words and potentially lose their investment. Please compare: Which is more imcompetent, RBA or AVZ management?
    I spent a bit of time writing this down to reassure the worried LTH. After reading my logical assessment, hopefully you guys feel better.
