The following is simplified and just my idea. I'm sure AKP have this figured out far better than me.

A device using AKP chips needs to be designed with a system for the chips to work, to produce sound.
In the demo Yuval stated there needs to be a processor in the device, the same as was on his donut.This processor runs proprietary software.
I imagine only AKP will supply this software to customers designing/making devices.The software will without doubt be "locked up" by some means and unable to be copied across to anyone else. AKP will have safeguards in place for this.A device maker will not have access or be able to use the software which activates the chips unless AKP is involved. AKP is only going to be involved with customers which have commercial terms for official chips.

Keeping it very simple then, with the above in mind, let's propose EM makes an extra batch of chips on the side and has a secret dodgy deal with a dodgy device manufacturer, how will that manufacturer implement the dodgy batch of chips? They will have to approach AKP to know how to implement and unlock/activate them. If AKP is not aware of and doesn't have formal commercial terms in place with that device manufacturer for chip supply (via EM no less) then AKP will obviously not help out here and unlock the potential of the chips by providing the secret means.The means will be secure and another device manufacturer also won't be able to sell or give the "secret key" to some other manufacturer? Even if they could somehow, why would one device manufacturer help another (a competitor) out that way? Not going to happen.
Maybe eventually it will be worked out how to do it all, and alternatives will emerge. But for the foreseeable future there is a large moat to the tech side, and this will protect the commercial side.

To me the whole thing (in a device) is a system and not just the sound producing chips. The chips on their own are useless pieces of hardware without the means to implement and activate them. Don't think of them as a voice coil speaker which only needs an amplifier. And anyone with basic electronics knowledge can design and build an amplifier. The chips do not function without the rest of the system. AKP not EM or anyone else will be tightly controlling the means to implement and activate the chips. This will be done individually with each device manufacturer, on the basis of a commercial agreement being met legitimately by the manufacturer.

Trust that the guys who developed this future tech, have not been lacking in overlooking this aspect.
