Australia really was Terra Nullius. There was no aboriginal organisation to negotiate with.The country was not occupied in any meaningful way.

The only way the High Court could fabricate an argument that Australia was not Terra Nullius was to find a Polynesian tribe on the islands North of Australia that had a semblance of property rights and then extrapolate that to apply across mainland Australia. The Mabo decision was a rort.
