My confusion is that Shine say they are preparing further submissions, not a new application. This distinction is very deliberate, as Shine will not bring another application after that judgment, but I do not understand what submissions they are preparing as Justice Lee did not leave it open for any further submissions.

Comments about further submissions and the court allowing another application are misleading where the submissions are meaningless, and you can always bring another application (even if it will only make matters worse).
