CHAPITRI UNIOUE: TRANSITIONAL AND FINAL PROVISIONS

Article 218: The provisions of the Mining Code have a legal value superior to those of the Establishment agreements.

Valid operating permits and authorizations for quarrying, remain subject, for their remaining duration and for the substances for which they have been granted, to the provisions of the legislative and regulatory texts that presided over their issuance. The expiration of an operating permit results in the lapse of the establishment agreement signed between its holder and the State. The renewal of the operating permit in in validity entails that of the establishment agreement. These renewals remain subject to the code mining in force on the day of renewal.

Valid research permits remain subject to the provisions of the code which has presided over their deliverance. However, the provisions of this code apply at the time of their renewal or when applying for an operating permit. A news establishment agreement for research must be negotiated on the basis of the mining code in force.

Article 219: Holders of existing large mine and small mine operating permits before the entry into force of this Code are required, within a period of six (6) months after its publication, to initiate a public consultation and discussions with the technical committee of monitoring of the community development plan. This consultation aims to conclude a or more local development support contracts in accordance with the provisions of this Mining Code with the local populations affected by the Project, in order to promote sustainable development.

Article 220: This law repeals all previous provisions to the contrary, in particular those of Ordinance No. 2019-022/P-RM of September 27, 2019 on the Mining Code in Republic of Mali.§
