Off the plan doesn't really apply here bc the buyer has a lot more walk away options than personal boat or home buyers. No multinational resource company is going to stick their neck out that far to commit to something when they can't be 100% assured of quality or quantity. MoU's, HoA's, OTA's are worth the paper they're written on.
