If I remember correctly, the initial ann was that $10 mil on Aug 6 and balance on Sept 6.

Today's ann read like $10 mil received as expected and it will only become non refundable on Sept 6 (if the buyer decided to proceed) subject to at least 20% title delivery..
..... and the balance will no longer be paid on Sept 6.
Otherwise, it make no sense for the buyer to pay in full with 'post settlement' issues still yet to be resolved come Sept 6.

Then there will be another 'post closing' settlement on Dec 2010 ... I assume the balance will be paid on Dec 2010 now subject to the remaining leases?

Can't they be less ambiguous and issue the full condition of the sales in details to the market? Too many ifs and buts, subject to this and that and still can't name the buyer.
