Additional complication is that funder would have already picked up $6 million from the Barnes settlement plus the funds that were put up as security of costs for Barnes part plus I thought Barnes paid some legal costs.
So funder has already recovered costs.
It comes down I am guessing to if the early termination clause is valid or not.
