can someone explain how Cominiere are legally obliged to pay this daily penalty? Who is it payable to? The ICC?

How likely is it that they will actually pay this, therefore care about the penalty? If they do pay, could it be seen as a cost of business for Zijin, which no doubt have the pockets to pay this penalty until AVZ cash reserves run dry at which point AVZ's legal offensive would taper off?
