One thing that interests me in this is whether or not it is open for the court to find that there was consensual sex. Both sides state explicitly that there was no consensual sex. Can the court, which is bound to produce a verdict based on evidence presented reject the evidence before it and state that consensual sex cannot be excluded? Or is it bound to the agreed fact that there was no consensual sex, so if sex occurred it was rape?
