    It will go to the appeals convenor to make a decision. The company will have an opportunity to provide a response to the appeal. The appeals convenor can only consider the assessment in consideration of the EP act and can only overturn a decision if he or she finds that the EPA failed to properly consider a piece of information such as a specific impact. What I mean is that the appeals convenor is not the EPA and can't overturn a decision just because they don't agree with it.

    So if the appeal is 'the EPA failed to consider the impact of ghg emissions', the proponent has an opportunity to show where they presented the ghg emissions in their referral and the convenor will look at the EPA report to see where they were considered and decide if due consideration was given in considerations of the act and associate regulations and guidance.

    note the above is just an example and I have no idea what the actual appeal is. Most appeals are dismissed but can take a long time as the next step is legal challenges which the government really wants to avoid.

    I am working on a project at the moment that's had thousands of appeals and we are well into the third year of dealing with them.
